Terms and Conditions

These General Terms and Conditions (AGB) govern the sale of Matchoya products by Shype Trading UG (haftungsbeschränkt) to consumers and businesses. By placing an order, you agree to these terms.

1. Scope (Geltungsbereich)

These terms apply to all contracts concluded between Shype Trading UG (haftungsbeschränkt), Bahnstr. 8, 65205 Wiesbaden, Germany (“Matchoya”) and the customer. They apply to consumers within the meaning of § 13 BGB and entrepreneurs within the meaning of § 14 BGB. Deviating terms of the customer are not accepted unless Matchoya explicitly agrees in writing.

2. Contract Formation (Vertragsschluss)

The presentation of products on the Matchoya website does not constitute a binding offer. By submitting an order, the customer makes a binding offer to conclude a purchase contract. The contract is concluded when Matchoya accepts the order by sending an order confirmation or by delivering the goods. Matchoya reserves the right to refuse orders in justified cases.

3. Prices and Payment

All prices are quoted in EUR and include the statutory value added tax. Shipping costs are displayed separately before the order is completed. Payment is due immediately unless otherwise agreed. Accepted payment methods include credit card, PayPal, bank transfer, and other methods displayed at checkout. For B2B orders, individual payment terms may apply.

4. Delivery and Shipping

Delivery is made within the delivery times indicated on the product pages. Shipping within the EU typically takes 2–5 business days. Matchoya ships from Wiesbaden, Germany. The risk of loss or damage passes to the customer upon handover to the carrier. For B2B orders, Incoterms and delivery schedules are agreed individually.

5. Withdrawal Right (Widerrufsrecht)

Consumers have a right of withdrawal within 14 days of receiving the goods, without giving reasons. The withdrawal period begins on the day the consumer or a third party designated by the consumer takes possession of the goods. To exercise the right of withdrawal, the consumer must clearly inform Matchoya (e.g. by email to hello@matchoya.com) of the decision to withdraw. Goods must be returned unused and in original packaging. Refunds will be processed within 14 days of receipt of the returned goods.

6. Retention of Title

Goods remain the property of Matchoya until full payment has been received. For B2B customers, extended retention of title may apply as agreed in the order confirmation.

7. Warranty (Gewährleistung)

Matchoya warrants that goods conform to the contract. Statutory warranty rights apply. For entrepreneurs, the warranty period is 12 months unless otherwise agreed. Defective goods may be replaced or repaired at Matchoya's choice. Matcha is a natural product; minor variations in color or flavor do not constitute a defect.

8. Applicable Law and Jurisdiction

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers resident in the EU, mandatory consumer protection laws of their country of residence remain applicable. The place of jurisdiction for disputes involving entrepreneurs is Wiesbaden, Germany.
